Terms of Use

1. General

These Terms of Use govern access to and use of the Cafe Simply mobile application and related public pages. By registering, accessing, or using the service, you confirm that you have read and accepted these terms.

If you use the service on behalf of a cafe, company, sole proprietor, or another organization, you represent that you have authority to act on behalf of that organization.

2. Service description

Cafe Simply is a digital tool for operating a cafe or other small food and beverage location. Depending on the product configuration, the service may include:

• shift schedules and related calculations;
• tasks, requests, and checklists;
• directories of locations, employees, suppliers, and products;
• recipes, instructions, and an internal team knowledge base;
• notifications, images, attachments, and related operational data.

3. Registration and account

• You must provide accurate and up-to-date information when using the service.
• You are responsible for keeping your login credentials secure and for actions performed under your account until you notify us of unauthorized access.
• We may request additional verification and may limit access if we suspect unauthorized use, abuse, or a material breach of these terms.

4. User-provided data

You decide what operational data, text, images, employee or supplier contacts, and other materials you upload to the service. You are responsible for making sure you have the necessary rights and legal basis to upload and process such information through the service.

5. Acceptable use

You agree not to use the service in a way that:

• violates applicable law or the rights of others;
• attempts to gain unauthorized access to other accounts, data, systems, or source code;
• interferes with the normal functioning of the service, including excessive automated load;
• involves malware, phishing, spam, fraudulent content, or other unlawful activity;
• could harm us, our users, or third parties.

6. Integrations and third-party services

Certain features rely on third-party infrastructure and services, including authentication, storage, notifications, analytics, document processing, and payment tools. Availability of those features may depend on the relevant third-party provider and its own technical or legal constraints.

7. Intellectual property

All intellectual property rights in the service, including the interface, software architecture, source code, design elements, branding, and related materials, belong to sole proprietor Ekaterina Stanislavovna Zhirova or are used lawfully. You receive a limited, non-exclusive, non-transferable right to use the service for its intended purpose while you have valid access to it.

8. Availability

We aim to keep the service stable and available, but we do not guarantee uninterrupted or error-free operation at all times. Downtime may occur because of maintenance, updates, infrastructure incidents, connectivity issues, provider outages, or other circumstances beyond our reasonable control.

9. Limitation of liability

• The service is provided on an "as is" and "as available" basis.
• To the maximum extent permitted by law, we are not liable for indirect or consequential losses, lost profits, loss of business opportunity, or loss of data.
• We are not responsible for the legality, accuracy, or completeness of content uploaded by users.
• We are not responsible for the actions or failures of third-party service providers, payment systems, app marketplaces, or network operators.

10. Suspension and termination

We may restrict, suspend, or terminate access to the service in whole or in part if a user:

• materially breaches these terms;
• uses the service unlawfully or in clearly bad faith;
• creates a risk to the security of the service, user data, or infrastructure.

11. Changes

We may revise these Terms of Use from time to time. The current version is published on the relevant public page. Continued use of the service after the effective date of an updated version means acceptance of the updated terms.

12. Governing law and disputes

These terms are governed by the law of the Russian Federation. The parties agree to try to resolve disputes through direct communication and written claims first. If a dispute cannot be resolved amicably, it will be handled in accordance with applicable law.
